Plush Terms of Service

By commissioning me, you agree that you have read, understood, and agreed with the following:

1) General Rules

- I reserve the right to refuse any commission for whatever reason. Being requested to create something that is considered hate speech / bigotry / discrimination will have you immediately blocked and removed from consideration from any future projects.- Although the reference material provided to me may be explicitly adult / NSFW, I only create general / SFW content.- NFTs are NEVER to be made of, with, or alongside my work. Under no circumstances shall my art be used for NFTs or any other business in regards to cryptocurrency.- I DO NOT consent to having my work used with AI 'art' in any possible way. My artwork is never to be used to train AI without my permission and may not be altered with AI in any form after the fact.- Unless stated otherwise, no artwork of mine is to be used without my permission for any and all commercial purposes, including (but not limited to) logos, prints, shirt designs, and other general merchandise. Please note that, of course, logo commissions and other pieces of work explicitly meant for this purpose are exempt from this clause.- You may contact me through any of the various websites where I post my content, but please allow 24-48 hours for me to respond. I am not always available right away, but will try my best to answer immediately at most times.- If the artwork needs to be completed before a deadline, I must be told so before artwork has begun. I am not to be held responsible for missing deadlines that weren’t made clear to me prior to payment being received.- I give my commissioners permission to repost their artwork on their own pages for personal use provided that you credit me and link back to me in some shape or form [Twitter, Instagram, Tumblr, Deviantart, Instagram, Furaffinity, etc.]- You cannot pay another artist to make changes of any kind to art that you’ve commissioned from me. You may make edits by yourself, however, as long as you don’t try to take credit for my initial artwork.

2) Payment

- I only accept payment through PayPal, and all payments are to be made in USD.- In order to pay for your commission, I will need a valid email tied to a PayPal account in order to send an invoice.- Due to needing supplies up front, I am not able to do payment plans on plush commissions. If you want to pay for a plush in increments, please consider using a credit card or loan service to do so.- Commission prices are subject to change based upon character complexity.- If I have not received payment or have lost contact after an extended amount of time, I reserve the right to cancel the commission and provide you with a refund.

3) Process

- To receive your finished artwork the fastest time possible, please be sure to respond to any messages in a timely manner.- Work in progress pictures will always be provided to you before the finished product. You are more than welcome to request changes and edits at the early stages of plush construction. And unless I ask the client directly for feedback, it is the client's responsibility to speak up if something needs to be altered from what was previously discussed.- Please note that large edits are difficult/impossible to do once the plush is nearing completion.- Plush commissions can take anywhere from a few weeks to a few months to be completed, depending on complexity, speed of communication, and my schedule. As stated earlier, I work on multiple projects while freelancing and may not be able to work every day on your commission in particular. Regardless, I will do my absolute best to have your piece completed in a timely manner of payment being received.

4) Revisions

- The best way to avoid needing revisions is to prevent them in the first place. Please do your best to provide me with clean, concise, and consistent reference material. If there isn't enough for me to work with, I may be able to draw the reference material for you at an additional cost.- General design notes will be discussed with the commissioner before work properly begins. Multiple parts of the design will be sent to the client for approval, including general plush shape and digitized embroidery.- If revisions are requested after the plush has been already finished, the client will be charged an additional cost - no exceptions. The amount of which is at my discretion and depends on how much I have to remake / redo. If the revision requested is a mistake made on my part, however, I will happily fix the mistake at no additional.

4) Copyright

- I retain the full rights to use all of my commissioned plushies in my advertising, examples for future commissions, and sharing on my social media. I may deny your commission if you do not want me to post it.- Unless they are of my own creation or stated otherwise, I am in no way, shape, or form claiming ownership over the character(s) created in my artwork.- NFTs are NEVER to be made of, with, or alongside my work. Under no circumstances shall my art be used for NFTs or any other business in regards to cryptocurrency. If I see someone breaking this part of the terms of service, I am entitled to take legal action.- Plush commissions are made for personal / gift use only. My patterns may not be reverse engineered or copied, ESPECIALLY for mass production.- The commissioner cannot claim to be the original maker or artist of the plush.

If a commission is over $300, I may be willing to be flexible with a payment plan (half up front, half upon completion, etc). This is to be discussed before work has begun.- Commission prices are subject to change based upon character/scene complexity, backgrounds, multiple characters, etc. If possible, additional charges will be discussed before an invoice is sent.- For all character commissions, after the initial sketch has been properly approved (i.e. before I have moved on to the lineart and coloring stage), there are to be no refunds.- If I have not received payment or have lost contact after an extended amount of time, I reserve the right to cancel the commission and provide you with a refund.

3) Process

You are more than welcome to request changes and edits at this time. As stated earlier, I do work a full time job and may not be able to work every day on your commission. Regardless, I will do my absolute best to have your piece completed within two weeks of payment being received.

4) Copyright

- I retain full commercial and distribution rights on any image that I produce. This means that I am able to make prints, stickers, buttons, shirts, etc., with the images I create. However, if I want to make a piece of merchandise with a character that belongs to a client, I will always ask for permission beforehand.- Unless they are of my own creation or stated otherwise, I am in no way, shape, or form claiming ownership over the character(s) drawn in my artwork.- NFTs are NEVER to be made of, with, or alongside my work. Under no circumstances shall my art be used for NFTs or any other business in regards to cryptocurrency. If I see someone breaking this part of the terms of service, I am entitled to take legal action.- I will not sell images containing characters belonging to other clients / commissioners without their permission.- The commissioner may use the commissioned image at any size as they please for personal use only (icons, backgrounds, etc). No profit is to be made off the image. Please note that said use includes any and all commercial purposes (logos, merchandise, selling their own prints, etc) unless stated otherwise beforehand.- The exception to the clause above is if the commissioned piece is explicitly made with the intention for commercial purposes, such as a logo.

Thank you for taking interest in my work! This page should answer any questions you have when thinking about commissioning me to create a handmade plush for you. Be sure to read this page in its entirety before sending any inquiries about a commission. If your question isn't answered here, feel free to ask me directly through my email ([email protected]) or a direct message on my Twitter, Tumblr, or Instagram. I'm more than happy to help!Please note that you must be 18 or older to commission me. My plushies are pieces of artwork that aren't designed for extensive use outside of gentle cuddling and display. I also cannot run the risk of handling large sums of money with minors. Thank you for understanding!


- Pricing -

Please note that the prices listed below are the base price for the plushies listed, and may sometimes need to be increases based upon complexity of the design that I'm working with. Price modifications depend on many things including amount of colors used, small patterns, clothing, accessories, unique body shapes, hairstyle complexity, and more.

Sitting Chibis

Plushies built on my sitting chibi base start at $350 before shipping. My sitting chibis are sewn on either my original body pattern featured on the above and left, or on Choly Knight's free vulpix pattern featured to the right.My sitting chibi plushies are around 10 to 12 inches tall upon completion and have pellets at the bottom of the torso to keep them from toppling over.

Ponies

Plushies built on my pony base start at $400 before shipping. Please note that the cost may change depending on the character's design, here are some flat rate common additions:- unicorn horns +$20
- folded pegasus wings +$40
- open pegasus wings w/ wire +$60
My pony plushies are around 12 to 14 inches tall upon completion and have pellets in the feet to keep them standing nice and stable. The pattern that I use is a scaled up and highly modified pattern created by Pattern Planet on Etsy. I am also able to stitch eyes that are show accurate or closer to my drawing style - your choice!

Laying / Sleepy Plush

Plushies built on a laying base start at $300 before shipping. My laying plushies are sewn on Teacup Lion's free pattern featured above. At the moment, I have no current examples of this type of commission. So if you'd like to be the first, be sure to let me know!

Mini Charm Plush

My mini charm plush commissions start at $150 before shipping. They feature a keychain security attached to a ribbon on top of the plush. Due to both the small scale and the way that these plushies are constructed, I may not be able to do complex details or patterns on the back of the character.

If you want a plush that looks different than the patterns mentioned previously, feel free to reach out to me anyways. I may be able to alter an existing pattern or create one from scratch. I am more than willing to work with you! :)


- Payment and Shipping -

- PayPal is required for payment.
Due to size and weight of the plush not being set in stone during creation, shipping is charged for after the plush has been completed.
- Shipping within the states (usually) ranges between $15 to $25.

- International shipping can vary quite a bit, but generally stays between $25 to $50 USD
- I am NOT responsible for any international import fees. Please look into your country's import fees, as they vary from country to country and are not my responsibility to cover.
- I am not able to do payment plans. If you want to pay for a plush in increments, please consider using a credit card or loan service to do so.
Once your plush has begun construction, the paid invoice is non-refundable. But because I understand that emergencies happen, I may be able to work with you under special circumstances


- Miscellaneous -

- My plushies, on general, take between three to five months to complete. Please note that I may be working on multiple projects at once, but I will do my absolute best to keep you posted with updates!
- All of my plushies are made with minky fabric unless stated otherwise. I have a book of sample swatches, and will do my best to match your character's design with the colors currently available on the market.
- In regards to allergies, my plushies are made in a smoke-free household. I should mention that I do have several pets at home, including a cat. Said cat is forbidden from entering my workspace / interacting with any of my supplies. No animals with fur are to make contact with my supplies and / or finished plushies under any circumstances. Otherwise, there shouldn't be any other allergen related issues. Just figured I'd be transparent!
- If something should happen to your plush where you need repairs, such as a popped stitch or a small tear, please let me know! I am more than willing to give you tips on how to repair it yourself. However, if worse comes to worse, we can consider having it sent to me to repair. Please note that this only applies to plushies I have made.
- I sew my plushies on a Singer Tradition sewing machine. My embroidery is made on my Brother PE-770 and is digitized by myself using Embird.

About / FAQ

Hi there, and welcome! My name is Emily, but I’m known around these parts as Oomles. I’m a 27-year-old freelancer who was born and raised in Bozeman, Montana. I lived there for my whole life until I took the dive and headed to the west coast in south California to pursue my dreams as a full time artist. I primarily do character illustrations, but I also have a lot of fun creating designs for stickers, shirts, enamel pins, and any other type of general "goodie" you can hold and play around with. Long story short... if I have time in the day, odds are I'm spending it making stuff!


Q: What kind of things do you enjoy?

A: I have too many hobbies and interests! It's exhausting and I don't know how to relax! But if you insist... I've been known to like:- Games! Be it video games, TCGs like Pokemon or Magic the Gathering, or tabletop RPGs like DnD, I love getting lost in a good interactive narrative.- Anime, western cartoons, and movies. If someone drew and / or modeled something and made it move around, odds are I'm interested.
- Theme parks, imagineering, and themed entertainment animatronics. My roommate and I are insufferable about Disney parks, and we're sorry for it.
- Sewing stuff! I primarily sew plushies, but I'd love to sew more costumes sometime soon.
- Critters! I love caring for aquariums and terrariums with live plants and non-mammalian animals, and educating others on the care and keeping of "less loved" animals is a passion of mine. If it doesn't have fur, odds are I have one somewhere in my house.

Q: Can I repost / use your art as an icon?

A: Icon yes, repost... probably no! If you use my artwork as an icon, I'd appreciate it if you gave credit somewhere. As far as reposting goes, I am mostly against it. That being said, if you commissioned me for the piece in question - post away! I want you to be happy with the work you receive from me and share it with the world :)

Q: What do you use to make your artwork?

A: In all honesty, a little bit of everything! I primarily use Clip Studio Paint for drawing, but I do various edits / additions with Photoshop (especially with any typography). I print all my stickers myself and cut them on a Silhouette Cameo. I make my buttons on an press I got over a decade ago through American Button Machines. I have recently learned that it is a Tercer brand machine, so I can recommend any of those. Anything embroidered is made on various fabrics with my Brother PE-770. All clay pins are made with polymer clay painted with a spray primer and acrylics. My jewelry varies in materials, but they're either made from laser cut acrylic (cut by an associate of mine), or in house with shrink plastic, vinyl, and UV resin.

Q: Are your stickers waterproof?

A: For the most part, yes! I print all my stickers with a professional laser-jet printer on polyester weatherproof material. The stickers can handle scratches and spills, but I wouldn't recommend them for use on locations with constant sun or rain exposure.

Q: I bought something from your shop - where is it?

A: If the item is a preorder, I am (most likely) waiting for manufacturing to ship me my products. Once the order and package are ready to go, I'll update said order with tracking. But once the package has been dropped off, it's almost entirely out of my hands - literally. Please give ample time for shipping, as I can't control what the USPS or UPS do once it's in transit. That being said, if you truly believe that your order got lost in the mail, message me directly. I'll do my best to make it right by you!
